Crockers Body Corporate Management Levy Collection Process up to 31 March 2017

If owners have an email address recorded with us, all notifications about the levy instalments will be forwarded to them through Crockers Direct. If an owner has opted to have all correspondence posted to them, then they will receive all statements and levy instalment invoices through the post at the address recorded with us.

Levies are sent with minutes of General Meetings or raised within 14 days of the General Meeting unless the body corporate Chairman instructs otherwise.  Crockers then adhere to the following process:

• 7 days (or whatever period the body corporate has resolved)  before the due date of the levy instalment, if the owner has provided their email address to us, a reminder email will be sent that the levy instalment is due for payment within 7 days.

• 7 days (or whatever period the body corporate has resolved)  after the due date of the levy instalment, if payment has not been received and the owner has provided their email address to us, a further reminder email, will be emailed to them advising that the payment is overdue. If the owner has opted for postal communication then a printed statement will be sent.

• 14 days (or whatever period the body corporate has resolved) after the due date of the levy instalment, if payment has not been received and the owner has provided their email address to us, a further reminder email will be emailed to them advising that the payment is overdue and they have 14 days to make payment or they may incur costs starting at $75.00+ GST. If the owner has opted for communication by post then the letter and a copy of their statement will be posted.

• 28 days (or whatever period the body corporate has resolved) after the due date of the levy instalment, if payment has not been received, the body corporate Account Manager will check on the status of the account to evaluate the history of payment by the owner and to ensure there is no other explanation such as funds being credited to the wrong unit where an owner owns multiple units in a complex.  Once these have been checked and confirmed that the funds have not been received, a letter will be sent to the owner by email and post giving 14 days to complete payment of the outstanding levy instalment and advising that a final demand, incurring a cost of $175+GST will be sent if payment is not received within the 14 day period. This process carries a cost of $75.00+GST which will be applied to the unit.

• 42 days (or whatever period the body corporate has resolved) after the due date of the levy instalment, if payment has not been received, the body corporate Account Manager will complete a Title search or Company Title search if the unit is in the name of a company. A Final Demand will be issued to the owner by email and post. This communication gives the owner notice that they have 14 days to pay the outstanding balance or authority will be sort from the committee to lodge a claim with the Tenancy Tribunal for recovery of all outstanding amounts. Interest of 10% per annum is calculated and added to the debt from the date that the levy was due. This process carries a cost of $175.00 + GST which will be charged to the unit.

• 56 days (or whatever period the body corporate has resolved) if payment of all outstanding amounts has not been received and the committee or the body corporate has instructed Crockers Body Corporate Management to proceed, a claim may be lodged at the Tenancy Tribunal or a Statutory Demand issued for the recovery of all outstanding amounts plus costs of the application to the Tenancy Tribunal.
